PART 5Powers of acquisition

Compulsory acquisition of land21.

(1)

The undertaker may acquire compulsorily so much of the Order land as is required to carry out or to facilitate, or is incidental to, the authorised development.

(2)

This article is subject to article 22 (time limit for exercise of authority to acquire land compulsorily), paragraph (2) of article 23 (compulsory acquisition of rights), article 27 (acquisition of subsoil only), article 29 (rights under or over streets), paragraph (8) of article 30 (temporary use of land for carrying out the authorised development), article 40 (crown rights) and article 41 (protective provisions).
