Treatment
17Urgent treatment to alleviate serious suffering
In section 62 of the Mental Health Act 1983 (urgent treatment)—
(a)
in subsection (1), for “Sections 57 and 58” substitute “Section 57”
;
(b)
“(1ZA)
Sections 57A and 58 do not apply to—
(a)
any treatment which falls within paragraphs (a), (b) or (d) of subsection (1), or
(b)
any treatment which falls within paragraph (c) of subsection (1) and is given to a patient who lacks capacity to consent to the treatment.”
