Amendment of regulation 34.

(1)

Regulation 3 (meaning of “superannuable pay and “final year’s superannuable pay”)4 is amended as follows.

(2)

In paragraph (6), for “paragraph (6A)”, substitute “paragraphs (6A) and (6B)”.

After paragraph (6A), insert—

“(6B)

If a member becomes entitled to a pension under regulation 16A (partial retirement pension), “final year’s superannuable pay” means superannuable pay in respect of the year immediately preceding the day on which the reduction in the member’s superannuable pay takes effect by virtue of which the member becomes entitled to the partial retirement pension.”.
