PART 7MISCELLANEOUS AND GENERAL
General
143Regulations
(1)
A power to make regulations under this Act is to be exercised by statutory instrument.
(2)
A power to make regulations under this Act includes power to make—
(a)
different provision for different purposes or different areas;
(b)
incidental, supplementary, consequential, transitory, transitional or saving provision.
(3)
A statutory instrument to which this subsection applies may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, Senedd Cymru.
(4)
Subsection (3) applies to a statutory instrument containing regulations under any of the following provisions—
(a)
from Part 1, section 22(1);
(b)
from Part 2, sections 25(2), 27(6), 32(2)(b), 34, 41(2), 46(6), 80(1)(c) and (2) and 83(4);
(c)
from Part 3, sections 88(3), 94(3) and (7)(b), 98(2), 99(6), 104(5) and 105(4);
(d)
from Part 4, sections 111(4), 112(1)(c) and 113(1);
(e)
from this Part—
(i)
section 145;
(ii)
section 146, but only where the regulations amend, repeal or otherwise modify a provision of an Act of Parliament, a Measure of the National Assembly for Wales or an Act of Senedd Cymru.
(5)
A statutory instrument containing regulations made by the Welsh Ministers under this Act to which subsection (4) does not apply is subject to annulment in pursuance of a resolution of Senedd Cymru.
