PART 9Interest and the payment, reduction or waiver of liabilities

Interest not payable under the 1995 Regulations or the 2008 Regulations
65.

(1)

This regulation applies in respect of any relevant amount payable by the legacy scheme to a person under or by virtue of Chapter 1 of Part 1 of PSPJOA 2022 where the scheme manager must calculate interest on that amount in accordance with regulation 64.

(2)

Where this regulation applies, the scheme manager must treat the relevant amount as if—

(a)

it is not a qualifying payment for the purposes of regulation T8 of the 1995 Regulations71 (interest on late payment of benefits), or

(b)

it is not an unpaid amount for the purposes of regulation 2.J.9 or regulation 3.J.9 of the 2008 Regulations72 (interest on late payment of benefits and refunds of contributions),

where it would be such a qualifying payment or unpaid amount but for this regulation.
