Explanatory note

Notification to the Secretary of State6.

(1)

An agreement is notified to the Secretary of State in accordance with this paragraph if the following details of the agreement are given to the Secretary of State in writing within 14 days of the relevant date—

(a)

the names of the independent providers or NHS bodies that are parties to the agreement;

(b)

a description of the nature of the agreement;

(c)

the date on which the agreement is made; and

(d)

the health services to which it relates.

(2)

In paragraph (1), “relevant date” means—

(a)

in the case of an agreement made before the coming into force of this Order, the date on which this Order comes into force; and

(b)

in any other case, the date on which the agreement is made.
