“Power to direct persons home6C.

(1)

Where the conditions in paragraph (2) apply to a person P, a relevant person may direct P to return to the place where they are living.

(2)

The conditions are-

(a)

that a relevant person considers that P is outside of the place where they are living after 8.00pm and before 6.00am; and

(b)

that P is engaged in, or is intending to engage in, activity prohibited by Regulations 4 to 6.

(3)

A relevant person may only exercise the power in this Regulation if the relevant person considers that it is a necessary and proportionate means of ensuring compliance with the restriction or requirement in Regulation 4 to 6”
