PART 1Amendment Provisions

The Conservation of Habitats and Species Regulations 201713.

(1)

The Conservation of Habitats and Species Regulations 201715 are amended as follows.

In regulation 7(1)—

(a)

omit the “and” at the end of paragraph (b);

(b)

after sub-paragraph (c), insert—“; and

(d)

an examining authority appointed under section 40 of the Infrastructure (Wales) Act 2024.”

(3)

In regulation 9(2)—

(a)

omit the “and” after sub-paragraph (m);

(b)

after sub-paragraph (n), insert—“; and

(o)

the Infrastructure (Wales) Act 2024.”.

In regulation 65, after paragraph (4), insert—

“(5)

Where the plan or project to which this regulation applies was consented to by an examining authority appointed under section 40 of the Infrastructure (Wales) Act 2024, the duties and functions in paragraphs (1) to (3) must be carried out by the Welsh Ministers.”
