10Applications for development consent: costs
(1)
The Planning Act 2008 is amended as follows.
(2)
In section 95 (hearings: disruption etc)—
(a)
omit subsections (4) and (5);
(b)
in the heading, omit “, supervision and costs”.
(3)
“96BCosts
(1)
The Examining authority may make orders about—
(a)
the costs of any person who—
(i)
is an interested party in relation to the application, or
(ii)
makes a written representation to the Examining authority about the application;
(b)
the person or persons who must pay the costs.
(2)
Every such order may be made a rule of the High Court on the application of any person named in the order.”
