Misuse
77Misuse of subsidies
(1)
A public authority which has given a subsidy has the right to recover from the beneficiary the whole or part of its amount to the extent that the subsidy is used for a purpose other than the purpose for which it was given.
(2)
The right conferred by subsection (1) is enforceable as if created by contract between the public authority and the beneficiary.
(3)
Nothing in this section affects any other remedy that the public authority may have in connection with the giving of the subsidy.
