Part 6Final provisions

58Ancillary provision

(1)

The Scottish Ministers may by regulations make any incidental, supplementary, consequential, transitional, transitory or saving provision they consider appropriate for the purposes of, in connection with or for giving full effect to this Act or any provision made under it.

(2)

Regulations under subsection (1) may—

(a)

modify any enactment (including this Act),

(b)

make different provision for different purposes.

(3)

Regulations under subsection (1)

(a)

are subject to the affirmative procedure if they add to, replace or omit any part of the text of an Act,

(b)

otherwise, are subject to the negative procedure.

59Commencement

(1)

The following provisions of this Act come into force on the days set out in the table below, with the day specified in the first column for the provision specified in the corresponding entry in the second column.

(2)

In relation to section 25—

(a)

subsections (6) and (7) come into force—

(i)

on 1 September 2022 for the purposes of making regulations under sections 18 and 18B of the Registration of Births, Deaths and Marriages (Scotland) Act 1965,

(ii)

on 24 September 2022 for all other purposes, and

(b)

the remaining subsections come into force on 24 September 2022.

In relation to section 27—

(a)

subsections (2), (4) and (6) come into force—

(i)

on 1 September 2022 for the purposes of making regulations under sections 23, 25 and 28ZA of the Registration of Births, Deaths and Marriages (Scotland) Act 1965,

(ii)

on 24 September 2022 for all other purposes, and

(b)

the remaining subsections come into force on 24 September 2022.

(4)

The other provisions of this Act come into force on such day as the Scottish Ministers may by regulations appoint.

(5)

Regulations under subsection (4) may—

(a)

include transitional, transitory or saving provision,

(b)

make different provision for different purposes.
