The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 19721 in relation to the common agricultural policy, and makes these Regulations under the powers conferred by that section and under the powers conferred by Article 78(b) of Regulation (EU) 1306/2013 of the European Parliament and of the Council on the financing, management and monitoring of the common agricultural policy in so far as it relates to the Common Agricultural Policy (“CAP”) direct payment schemes2.

The function of the former Minister of Agriculture, Fisheries and Food of making regulations under section 2(2) was transferred to the Secretary of State by article 2(2) of the Minister of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).

Regulation (EU) 1306/2013 in so far as relating to Direct Payments schemes was incorporated into domestic law by the Direct Payments to Farmers (Legislative Continuity) Act 2020 (c. 2). Article 78 was amended by regulation 7(16) of S.I. 2020/90.
