Powers to make consequential or transitional provision, etc
85Power to make consequential amendments
(1)
The Secretary of State may by regulations make provision that is consequential on any provision made by or under—
(a)
Parts 1 to 5,
(b)
section 68, F1… 70 or 71,
(c)
section 72 or Part 1 of Schedule 3, or
(d)
section 76, 77, 78, 79, 81 or 82.
(2)
The appropriate national authority may by regulations make provision that is consequential on any provision made by or under section 80.
(3)
In subsection (2) “the appropriate national authority” means—
(a)
in relation to England, the Secretary of State;
(b)
in relation to Wales, the Welsh Ministers.
(4)
The power of the Secretary of State to make regulations under this section may, in particular, be exercised by amending, repealing, revoking or otherwise modifying any provision made by or under an Act passed before, or in the same session of Parliament as, this Act.
(5)
The power of the Welsh Ministers to make regulations under this section may, in particular, be exercised by amending, repealing, revoking or otherwise modifying any provision made by or under primary legislation passed or made before, or in the same session of Parliament as, this Act.
(6)
In subsection (5) “primary legislation” means—
(a)
an Act of Parliament;
(b)
a Measure or Act of the National Assembly for Wales or an Act of Senedd Cymru.
