Explanatory note

Duty to give a notice10.

(1)

This article applies to a child who on 1 September 2022 has identified special educational needs and who is in a nursery class, year 1, year 5, year 9 or year 10 during the school year 2022-2023.

(2)

Subject to article 12, the governing body which provides the special educational provision to the child must either give an IDP notice or a no needs notice to the child and the child’s parent during the 2022-2023 school year.
