Amendment of the Health Protection (Coronavirus, Restrictions) (Steps) (England) Regulations 20212.
(1)
The Health Protection (Coronavirus, Restrictions) (Steps) (England) Regulations 2021 are amended as follows.
(2)
In regulation 2(5)—
(a)
in sub-paragraph (d)(ii), for “another” substitute “a”;
(b)
in sub-paragraph (i)(ii), omit “or as otherwise specified,”.
(3)
In regulation 3(2)—
(a)
in sub-paragraph (d), for the words from “who are” to the end, substitute “, at least one of whom is under the age of one or was under that age on 2nd December 2020,”;
(b)
in sub-paragraph (e), for the words from “who have” to the end, substitute “, at least one of whom has a disability, requires continuous care and is under the age of five, or was under that age on 2nd December 2020, or”.
(4)
In regulation 14(3)(b)(iii), for “any other place indoors” substitute “in any other place”.
(5)
In Schedule 1, in paragraph 11(7), for “sub-paragraph (1)” substitute “paragraph 9(1)”.

cafes or canteens at a hospital or care home,
(ii)
cafes or canteens at a school, a provider of post-16 education or training (as defined in paragraph (e) of the definition of “relevant institution” in paragraph 1(8) of Schedule 17 to the Coronavirus Act 2020) or educational accommodation for students attending higher education courses,
(iii)
cafes or canteens at a higher education provider, where there is no practical alternative for staff and students at that institution to obtain food or drink, and alcohol is not served for consumption on the premises,
(iv)
canteens at criminal justice accommodation, immigration detention accommodation or an establishment intended for use for Her Majesty’s armed forces or for the purposes of the Department of the Secretary of State responsible for defence,
(v)
workplace canteens where there is no practical alternative for staff at that workplace to obtain food or drink and alcohol is not served for consumption on the premises, or
(vi)
services providing food or drink to the homeless;”.

In Schedule 4—
(a)
in Part 1, omit the words from “Every area” to the end of the sentence;
(b)
“Every area of England (including the territorial waters adjacent to England and the airspace above England and those territorial waters).”.
