The Secretary of State, having been designated M1 for the purposes of section 2(2) of the European Communities Act 1972 M2 in relation to measures relating to the environment, in exercise of the powers conferred by section 2(2) of that Act and sections 48(1), 56(3) and (7), 114(2), 123(4), 232(3) and 235(1) of, and paragraphs 2(8) and 4(4) of Schedule 6 to, the Planning Act 2008 M3, makes the following Regulations.
