47Suspensive claims: duty to remove
(1)
A person who has been given a removal notice may not be removed from the United Kingdom under this Act to the country or territory specified in the removal notice during any of the following periods—
(a)
(b)
(c)
(d)
(2)
Where—
(a)
(b)
the person may not be removed from the United Kingdom under this Act to the country or territory specified in the removal notice.
(3)
But if at any time it appears to the Secretary of State that there has been a change of circumstances in relation to the person—
(a)
(4)
In subsection (3) the reference to a change of circumstances in relation to a person includes in particular where any—
(a)
human rights claim, or
(b)
application for judicial review,
made by the person in relation to their removal from the United Kingdom is not successful.
