(1)
Section 28 (functions of justices’ clerks and assistant clerks) is amended as follows.

“(2A)
Subsection (2) does not apply in relation to functions of a justices’ clerk given under section 31O(1)(a), or specified in section 31O(2), of the Matrimonial and Family Proceedings Act 1984 (functions in the family court, but see section 31O(1)(b) of that Act).”

“(5A)
For the purposes of subsections (1) to (5) the functions of justices of the peace do not include functions as a judge of the family court.”
(4)
Omit subsection (9)(b) (requirement to consult Family Procedure Rule Committee) but not the “and” following it.
