Offences and penalties4.
(1)
An operator who fails to comply with regulation 3 commits an offence when the aircraft arrives in Scotland.
(2)
An operator who commits an offence under paragraph (1) is liable—
(a)
on summary conviction, to a fine not exceeding the statutory maximum,
(b)
on conviction on indictment, to a fine.
