88Non-solicitor investors: factors as to fitness

In section 64 (factors as to fitness) of the 2010 Act—

(a)

in subsection (4)—

(i)

in the opening words, the words “(to any extent)” are repealed,

(ii)

in paragraph (a), before “ownership” insert “significant”,

(b)

after subsection (4) insert—

“(4A)

For the purpose of subsection (4)(a), whether a person has significant ownership or control of the body is to be determined by the approved regulator.”.
