Hussain [2018] EWCA Crim 2673
The appellant was convicted of making preparation for terrorist acts. Toward the end of his trial the bombing at the Manchester Arena occurred and the defence invited the judge to consider whether a fair trial was still possible. The judge asked two questions of the jury to ascertain if they had any connection to those involved or connected and whether, in light of the events in Manchester, they could abide by their oath.
The application to discharge was refused. The Court of Appeal had no hesitation in concluding the judge was correct in doing so. Three were other grounds of appeal, also rejected as was the appeal against sentence.
