Danny Ross [2019] EWCA Crim 1647

The appellant was committed for sentence having pleaded guilty to five offences of theft and six breaches of a Criminal Behaviour Order. All were committed during the operational period of a suspended sentence of 12 weeks imposed for similar offences. The total term imposed was 30 month’s imprisonment.

Held: the persistence and shamelessness of the breaches viewed through the lens of yet another breach (of the CBO for which imprisonment had been suspended) amply illustrated why the matter was positioned appropriately. The structured sentencing remarks were unimpugnable. The appeal was dismissed.
