The appellant was convicted of wounding and sentenced to 18 months’ imprisonment. She used a broken bottle and pushed it into the face of the complainant with serious consequences. Usually, this would normally lead to an immediate term of imprisonment. In this case, the court was persuaded that the sentence should have been suspended. The appellant did not present as a risk to the public, and there was a realistic prospect of rehabilitation. There was strong personal mitigation, in particular, the effect on her two young children. The Imposition guideline, properly applied, pointed clearly to a suspended sentence.
The sentence was quashed, and the term of imprisonment was suspended for two years with a rehabilitation activity requirement of 45 days.
