Khan [2019] EWCA Crim 825
The appellant was made subject to an extended sentence of 5 years comprising a custodial term of 4 years and 6 months for a s20 wounding with an 18 month term to run concurrently for possession of the knife used in the assault.
The sentence was unlawful as the extension period must be at least for one year by virtue of s226A(7A) of the CJA 2003.
The unlawful sentence was quashed and substituted with an extended sentence of four years with a one year extension period, the concurrent sentence to remain undisturbed.
